ACCEPTANCE OF TERMS
The services of Planned Departure is available to the user subjected to the following terms of use. By using the Planned Departure the user accepts to comply with all provisions of these terms.
The right to use Planned Departure is personal to user and is not transferable either to any other person or entity. The user is responsible for all use of user's account and ensure that all use of user's account is fully consistent with these general conditions. The user shall be responsible for maintaining the confidentiality of user's password.
Planned Departure shall be entitled at any time to modify or remove any part or feature of the Service.
CHANGED TERMS
Planned Departure reserves the right to update these terms and conditions at any time. The most current version of can be found on Planned Departure's website.

DESCRIPTION OF SERVICE
Planned Departure provides the user ability to store important information about their life and transfer it to a designated beneficiary upon the death or disability of the user and after getting verification from the designated verifiers.
User add verifiers and beneficiaries in the system.
User update important information about their life which is worth transferring to other people.
Planned Departure contacts designated verifiers and beneficiaries unless specified otherwise by the user.
Upon death or disability of the user, Planned Departure contacts verifiers for the proof and verification of the same.
Planned Departure contacts verifier if some one reports that a user is passed away for proof and clarification.
Upon getting confirmation, designated beneficiaries are granted access to specific information.
If specified by the user an online obituary can also be setup for the user with designated moderators.
The Services, including any updates, enhancements, new features, and/or the addition of any new web properties, are subject to the Terms and Condition.
USE OF SERVICES
Planned Departure will monitor user's response to our automated emails, user's Twitter and Facebook account to ensure that user is still active and has not passed away. If these accounts are used by some one else after user's death because of any reason, our system will have no way of identifying it. In such cases, we will only come to know about user's death if someone uses "Report A Passing" feature to tell us that user has passed away.
Planned Departure is responsible for giving instruction to other people on behalf of user. It has no access to and will not follow these instruction on behalf of users.
Planned Departure allows user to upload images, notes and many other types of information and user understands and agrees to not abuse the system by using it to distribute any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information. Also, Planned Departure can not be used for files that contain images, photographs, software or other material protected by intellectual property laws, including, but not limited to, copyright and trademark laws (or rights of privacy and publicity) unless user owns or controls the rights to the content or have received all necessary approvals to do the same.
Planned Departure can not be used to upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of other computer or other property.
Planned Departure take no responsibility if information delivered to the beneficiary violate or harm beneficiary in any way. Planned Departure is acting as a courier and does not scrutinize the information it delivers. Planned Departure reserves the right to disclose information where it is necessary to satisfy any applicable law, regulation, legal process or governmental request. Planned Departure also reserve the right to edit, refuse to post or to remove any information or materials, in whole or in part, by Planned Departure's sole discretion.
Planned Departure will not under any circumstances give up registered information to any third party that may identify you as users of Planned Departure.
Planned Departure may refuse to pass information to the beneficiaries if user's account is in suspended state because of the non-payment. We will however release this information as soon as account is settled by the beneficiary or anyone else on behalf of users.
MEMBER ACCOUNT, PASSWORD AND SECURITY
The user must complete the registration process of Planned Departure by providing current, complete and accurate information as requested in the applicable registration form. In addition, users are totally responsible for all activities that occur under user's account. The user agrees to contact Planned Departure immediately on any unauthorized use of user's account or any other breach of security. Planned Departure is not responsible for lost or damaged materials caused by technical problems or forced attack on our systems. Planned Departure will try best to prevent various malfunctions.
PROTECTING THE PERSONAL INFORMATION
In order to protect the data Planned Departure is collecting it uses organizational measures as well as several approaches and safeguards to prevent unauthorized access and use thereof. We store personal information on servers located in secure premises with restricted access.
COOKIES
We use cookies on certain pages of the Site. Cookies are small text files that are stored temporarily in your computer's RAM memory or stored on the hard disk when using the Service. Cookies can not spread the virus to your computer. Cookies are primarily used to make the service easier to use by Members. Cookies help to reduce the processing time for certain applications because the computer has stored information from previous visits for future visits. The contents of Planned Departure is protected under copyright law. You may not modify, copy, redistribute, publish, license or create derivative works from, transfer or sell any information, products or services obtained through this site. The material may not be used in the competing view.
END
Planned Departure and User may terminate this Agreement with immediate effect. Planned Departure has the right to immediately terminate user's account at any conduct by users of Planned Departure in its sole discretion, considers to be unacceptable, or in the event of infringement by users of this Agreement.
These conditions apply from 1 Oct 2010.
